/FAQ: Domestic Violence & Terminating A Lease
I get asked about all sorts of topics in regards to real estate and a popular one is about leasing a property. Unfortunately sometimes the subject of domestic violence comes and and as well as terminating the lease. So can you terminate a lease (IN TEXAS) if there is domestic violence occurring at the property?
First things first, this is not legal advice and I am not licensed to practice law, if you want actual legal advice I suggest you seek it and consult with an attorney. This subject I am discussing and answer only applies to Texas.
The answer is yes, a tenant can terminate under the Texas Property Code. Watch the video for the specific section. Please know that the answer I am referring to is of domestic violence between tenants. The relationship does not matter, such as husband and wife, but also just roommates. The tenant who is terminating would also have to get a court order and provide it to the landlord. So a tenant can not just claim they were abused and want out but they have to go as far as getting a court order and providing it to the landlord before terminating the lease.
